Welcome to MeasuringLens, an iOS application developed by RealTek Labs LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of the MeasuringLens mobile application and any related services (collectively, the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
The App utilizes your device's camera to estimate measurements, allowing for the overlay of these measurements on a video feed of a drinking glass. This functionality is intended to assist users in measuring volumes.
The App is designed with your privacy in mind. It does not collect, record, store, transmit, or otherwise process any personal data, video feeds, images, or any other user-specific information. All measurement estimations and overlays are processed locally on your device in real-time and are not saved or sent to RealTek Labs LLC or any third party. There is no tracking of your usage within the App.
Accurate Use: You are responsible for using the App as intended and understanding that the measurements provided are estimations and may not be perfectly precise.
Device Requirements: You are responsible for ensuring your device meets the necessary technical specifications for the App to function correctly.
Compliance with Laws: You agree to use the App in compliance with all applicable local, state, national, and international laws and regulations.
No Misuse: You agree not to use the App for any unlawful, harmful, or fraudulent purpose, or in any way that could damage, disable, overburden, or impair the App.
The App, including all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by RealTek Labs LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The App is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. RealTek Labs LLC does not warrant that the App will be accurate, reliable, uninterrupted, secure, or error-free, or that defects will be corrected.
In no event shall RealTek Labs LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
These Terms shall be governed and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
